In the case of Panagacos v Towery, US Army Force Protection Division employees at Fort Lewis in Washington State have appealed a state order. The order denies motions to dismiss 1st and 4th Amendment claims brought against them by Olympia-area activists.
The activists say that Towery and Rudd violated their 1st and 4th Amendments when Rudd directed Towery to infiltrate activist groups in order to collect information, which Rudd began using in threat assessments through local law enforcement. The information collected was intended to neutralize protester actions aimed at shipments of military vehicles through the ports of Olympia, Tacoma and Gray's Harbor.
